The Latest "Stella Awards"

Well, this just goes to show you that there are a lot of dumb folks out there!!  What is really scary is the fact that our "peers" were involved with the awards!  Why can't I think of blaming someone else for my stupid behaviors!!

It's time again for the annual "Stella Awards"! For those unfamiliar with these awards, they are named after 81-year-old Stella Liebeck who spilled hot coffee on herself and successfully sued the McDonald's in New Mexico, where she purchased coffee.  She took the lid off the coffee and put it between her knees while she was driving.  Who would ever think one could get burned doing that, right?

These are awards for the most outlandish lawsuits and verdicts in the U.S., you know, the kinds of cases that make you scratch your head. So keep your head scratcher handy.

Here are the Stella's for this year:

--------------------------

SEVENTH PLACE

Kathleen Robertson of Austin, Texas was awarded $80,000 by a jury of her peers after breaking her ankle tripping over a toddler who was running inside a furniture store. The store owners were understandably surprised by the verdict, considering the running toddler was her own son.

Start scratching!

--------------------------

SIXTH PLACE *

Carl Truman, 19, of Los Angeles, California won $74,000 plus medical expenses when his neighbor ran over his hand with a Honda Accord Truman apparently didn't notice there was someone at the wheel of the car when he was trying to steal his neighbor's hubcaps.

Scratch some more...

--------------------------

FIFTH PLACE *

Terrence Dickson, of Bristol, Pennsylvania, was leaving a house he had just burglarized by way of the garage. Unfortunately for Dickson, the automatic garage door opener malfunctioned and he could not get the garage door to open. Worse, he couldn't re-enter the house because the door connecting the garage to the house locked when Dickson pulled it shut. Forced to sit for eight, count 'em, EIGHT days and survive on a case of Pepsi and a large bag of dry dog food, he sued the homeowner's insurance company claiming undue mental anguish. Amazingly, the jury said the insurance company must pay Dickson $500,000 for his anguish. We should all have this kind of anguish.

Keep scratching. There's more..

Double hand scratching after this one.

-------------------------------

FOURTH PLACE *

Jerry Williams, of Little Rock, Arkansas, garnered 4th Place in the Stella's when he was awarded $14,500 plus medical expenses after being bitten on the butt by his next door neighbor's beagle - even though the beagle was on a chain in its owner's fenced yard. Williams did not get as much as he asked for because the jury believed the beagle might have been provoked at the time of the butt bite because Williams had climbed over the fence into the yard and repeatedly shot the dog with a pellet gun.

Pick a new spot to scratch, you're getting a bald spot.

-----------------------------------

THIRD PLACE *

Amber Carson of Lancaster, Pennsylvania because a jury ordered a Philadelphia restaurant to pay her $113,500 after she slipped on a spilled soft drink and broke her tailbone The reason the soft drink was on the floor: Ms Carson had thrown it at her boyfriend 30 seconds earlier during an argument.

Only two more so ease up on the scratching..

-------------------------------------

*SECOND PLACE*

Kara Walton, of Claymont, Delaware sued the owner of a night club in a nearby city because she fell from the bathroom window to the floor, knocking out her two front teeth. Even though Ms. Walton was trying to sneak through the ladies room window to avoid paying the $3.50 cover charge, the jury said the night club had to pay her $12,000....oh, yeah, plus dental expenses. Go figure.

Ok. Here we go!!

---------------------------------

FIRST PLACE *

This year's runaway First Place Stella Award winner was: Mrs. Merv Grazinski, of Oklahoma City, Oklahoma, who purchased a new 32-foot Winnebago motor home. On her first trip home, from an OU football game, having driven onto the freeway, she set the cruise control at 70 mph and calmly left the driver's seat to go to the back of the Winnebago to make herself a sandwich. Not surprisingly, the motor home left the freeway, crashed and overturned. Also not surprisingly, Mrs. Grazinski sued Winnebago for not putting in the owner's manual that she couldn't actually leave the driver's seat while the cruise control was set. The Oklahoma jury awarded her--are you sitting down?--$1,750,000.  PLUS a new motor home. Winnebago actually changed its manuals as a result of this suit, just in case Mrs. Grazinski has any relatives who might also buy a motor home.

Colombo Nails It!

I think we all understand the problem, How do we fix the system is the BIG question.
Police Retraining

Der Unterschied: Columbo ?berf?hrt M?rder. Now let me see if I have this right.

There's no guidance or discipline in the home.  The family situation is so unstable, 'Junior' doesn't even know where or to whom to send a Father's Day card.

Junior gets dumped into the education system where he is socially promoted because the overwhelmed school district can't deal with the undisciplined whelp.

Junior's major formative influences are 'gangsta' rap videos and a corresponding peer group of gangsta wannabes.

At age 18, Junior is turned loose on society carrying a bad attitude, a broken compass and little respect for authority.

Junior gets himself in big trouble with the law and meets dire consequences.

Then, the situation diagnosis is that the police need more training and understanding?

Pardon me for asking, but do you really believe this bullshit?

A lack of respect here... payback!

A lawyer and a senior citizen are sitting next to each other on a long flight. The lawyer is thinking that seniors are so dumb that he could get one over on them easy. So the lawyer asks if the senior would like to play a fun game. The senior is tired and just wants to take a nap, so he politely declines and tries to catch a few winks.

The lawyer persists saying that the game is a lot of fun. I ask you a question, and if you don’t know the answer, you pay me only $5. Then you ask me one, and if I don’t know the answer, I will pay you $500, he says.

This catches the senior’s attention and to keep the lawyer quiet, he agrees to play the game. The lawyer asks the first question. ‘What’s the distance from the Earth to the Moon?’ The senior doesn’t say a word, but reaches into his pocket, pulls out a five-dollar bill, and hands it to the lawyer.

Now it’s the senior’s turn. He asks the lawyer, ‘What goes up a hill with three legs, and comes down with four?’ The lawyer uses his laptop and searches all references he could find on the Net. He sends e-mails to all the smart friends he knows; all to no avail. After an hour of searching, he finally gives up. He wakes the senior and hands him $500. The senior pockets the $500 and goes right back to sleep.

The lawyer is going nuts not knowing the answer. He wakes the senior up and asks, ‘Well, so what goes up a hill with three legs and comes down with four?’ The senior reaches into his pocket, hands the lawyer $5 and goes back to sleep.

What would you say?

From my email...

Ole’s car was hit by a truck in an accident.

In court, the trucking company’s lawyer was questioning Ole. ‘Didn’t you say, sir, at the scene of the accident, ‘I’m fine, ?’ asked the lawyer.

Ole responded, ‘Vell, I’ll tell you vat happened. I had yust loaded my favorite mule, Bessie, into da…..’

‘I didn’t ask for any details’, the lawyer interrupted. ‘Just answer the question. Did you not say, at the scene of the accident, ‘I’m fine’?

Ole said, ‘Vell, I had yust got Bessie into da trailer and I vas driving down da road… .

The lawyer interrupted again and said, ‘Judge, I am trying to establish the fact that, at the scene of the accident, this man told the Highway Patrolman on the scene that he was just fine. Now several weeks after the accident he is trying to sue my client. I believe he is a fraud. Please tell him to simply answer the question.’

By this time, the Judge was fairly interested in Ole’s answer and said to the lawyer, ‘I’d like to hear what he has to say about his favorite mule, Bessie.’

Ole thanked the Judge and proceeded. ‘Vell, as I vas saying, I had yust loaded Bessie, my favorite mule, into da trailer and vas driving her down da highvay ven dis huge semi-truck and trailer ran da stop sign and smacked my truck right in da side. I vas trown into one ditch and Bessie vas trown into da other. I vas hurting real bad and didn’t vant to move. However, I could hear Bessie moaning and groaning. I knew she was in terrible shape yust by her groans’.

‘Shortly after da accident da Highway Patrolman, he came to da scene.. He could hear Bessie moaning and groaning so he vent over to her’.. ‘After he looked at her and saw her fatal condition he took out his gun and shot her right ‘tween da eyes.

Den da Patrolman, he came across da road, gun still smoking, looked at me and said, ‘How are you feeling?’

‘Now vat da hell vould YOU say?

Florida court sets Atheist Holy Day

From my email,

In Florida , an atheist created a case against the upcoming Easter and Passover Holy days. He hired an attorney to bring a discrimination case against Christians and Jews and observances of their holy days. The argument was that it was unfair that atheists had no such recognized days.

The case was brought before a judge. After listening to the passionate presentation by the lawyer, the judge banged his gavel declaring,"Case dismissed!"

The lawyer immediately stood objecting to the ruling saying, "Your honor, How can you possibly dismiss this case? The Christians have Christmas, Easter and others. The Jews have Passover, Yom Kippur and Hanukkah, yet my client and all other atheists have no such holidays.."

The judge leaned forward in his chair saying, "But you do. Your client, counsel, is woefully ignorant."

The lawyer said, "Your Honor, we are unaware of any special observance or holiday for atheists."

The judge said, "The calendar says April 1st is April Fools Day. Psalm 14:1 states, 'The fool says in his heart, there is no God.' Thus, it is the opinion of this court, that, if your client says there is no God, then he is a fool. Therefore, April 1st is his day. Court is adjourned."

Only in America!

A Charlotte, North Carolina lawyer purchased a box of very rare and expensive cigars and then insured them against fire, among other things.

Within a month, having smoked his entire stockpile of these great cigars and without yet having made even his first premium payment on the policy, the lawyer filed a claim against the insurance company.

In his claim, the lawyer stated the cigars were lost "in a series of small fires."

The insurance company refused to pay, citing the obvious reason that the man had consumed the cigars in the normal fashion.

The lawyer sued and WON!

In delivering the ruling, the judge agreed with the insurance company that the claim was frivolous.

The judge stated nevertheless, that the lawyer "held a policy from the company in which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be unacceptable fire "and was obligated to pay the claim".

Rather than endure lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000 to the lawyer for his loss of the cigars lost in the "fires".

NOW FOR THE BEST PART!

After the lawyer cashed the cheque, the insurance company had him arrested on 24 counts of ARSON!!!

With his own insurance claim and testimony from the previous case being used against him, the lawyer was convicted of intentionally burning his insured property and was sentenced to 24 months in jail and a $24,000 fine.

This is a true story and was the First Place winner in the recent Criminal Lawyers Award Contest.

ONLY IN AMERICA! No wonder third world countries think we're nuts!

Ridiculous Laws

Neal Boortz has a nice list today of ridiculous laws passed by governments. They include:

Here's a look at Britain's most ridiculous laws:

** It is illegal to die in the Houses of Parliament
** It is an act of treason to place a postage stamp bearing the British king or queen's image upside-down
** It is illegal for a woman to be topless in Liverpool except as a clerk in a tropical fish store
** Eating mince pies on Christmas Day is banned
** If someone knocks on your door in Scotland and asks to use your toilet, you are required to let them enter
** In the UK a pregnant woman can legally relieve herself anywhere she wants, including in a policeman's helmet
** The head of any dead whale found on the British coast automatically becomes the property of the King, and the tail of the Queen
** It is illegal not to tell the tax man anything you do not want him to know, but legal not to tell him information you do not mind him knowing
** It is illegal to enter the Houses of Parliament wearing a suit of armor
** It is legal to murder a Scotsman within the ancient city walls of York, but only if he is carrying a bow and arrow.

And the British also took the time to vote on their favorite asinine laws from other countries. I am proud to say that the US had 4 out of the 9 laws.

** In Ohio, it is illegal to get a fish drunk
** In Indonesia, the penalty for masturbation is decapitation. (Which head?)
** A male doctor in Bahrain can only examine the genitals of a woman in the reflection of a mirror
** In Switzerland, a man may not relieve himself standing up after 10pm. I think this has something to do with leaving the seat up.
** It is illegal to be blindfolded while driving a vehicle in Alabama
** In Florida, unmarried women who parachute on a Sunday could be jailed
** Women in Vermont must obtain written permission from their husbands to wear false teeth
** In Milan, it is a legal requirement to smile at all times, except during funerals or hospital visits
** In France, it is illegal to name a pig Napoleon
